Massachusetts automatically provides a one hundred twenty five thousand dollar ($125,000) homestead protection on primary residences. This protects the value of the homeowners property against attachment, seizure, execution on judgment, levy or sale for payment of debts.
The Massachusetts Homestead Declaration allows a homeowner to increase this protection up to five hundred thousand dollars ($500,000) per residence, per family when filed at the Registry of Deeds in the county or district where the property is located.
This declaration can only be filed on principal residences, and the recordation of this document costs $35. This declaration is also automatically subordinate to any mortgage on the home.
